Esta tesis estudia el tratamiento institucional de la justicia retroactiva por las violaciones de los derechos humanos cometidas durante la última dictadura uruguaya, a lo largo de casi cuatro décadas. El evento central es la Ley de Caducidad (1986), una amnistía sancionada por el Parlamento y confirmada dos veces por la ciudadanía mediante mecanismos de democracia directa (referéndum de 1989 y plebiscito de 2009). Pese a ese respaldo democrático, los tribunales pasaron luego a considerarla jurídicamente inexistente. La pregunta que organiza la investigación es cómo fue posible ese giro de ciento ochenta grados, de la amnistía al castigo, sin que la Constitución de 1967 ni las competencias institucionales se modificaran nunca. La hipótesis sitúa la respuesta en la interpretación jurídica. Para reconstruirla, la autora propone la noción de clima interpretativo y distingue dos: el del constitucionalismo débil (con democracia fuerte), que cerraba el debate con la ley y los pronunciamientos populares, y el del constitucionalismo fuerte (con democracia débil), que lo mantiene abierto y reserva a los jueces la última palabra. El desplazamiento se apoyó en la interpretación dinámica de la cláusula de reserva (artículo 72), el vaciamiento de la parte orgánica y la preferencia por cláusulas abiertas. En lo metodológico, combina teoría aplicada con un estudio empírico e histórico de fuentes primarias (leyes, actas parlamentarias, sentencias y comparecencias de juristas). La principal preocupación que deja planteada es el debilitamiento democrático y la alienación constitucional que supone restringir el derecho a la participación política. This thesis examines how Uruguay's constitutional institutions handled retroactive justice for the human rights violations committed under the last dictatorship, across nearly four decades. The central event is the 1986 Ley de Caducidad, an amnesty passed by Parliament and twice confirmed by citizens through direct democracy (the 1989 referendum and the 2009 plebiscite). Despite that democratic backing, courts later came to treat it as juridically nonexistent. The organizing question is how this 180-degree turn, from amnesty to punishment, became possible without the 1967 Constitution or institutional competences ever being amended. The hypothesis locates the answer in legal interpretation. To reconstruct it, the author proposes the notion of interpretive climate and distinguishes two: weak constitutionalism (with strong democracy), under which the statute and the popular votes closed the debate over retroactive justice, and strong constitutionalism (with weak democracy), under which that debate stays open and judges hold the final word. The shift relied on the dynamic interpretation of the open reserve clause (article 72), the hollowing out of the Constitution's organic part, and a preference for open-ended clauses. Methodologically, it combines applied legal theory with an empirical and historical study of primary sources (statutes, parliamentary records, judgments, and jurists' testimony before committees).
