El trabajo aborda la aplicación temporal de los artículos 99 y 100 de la Ley 27.742, cuestionando cómo deberían interpretarse jurídicamente para garantizar la seguridad jurídica y la progresividad de los derechos laborales. La hipótesis plantea que estas normas no deben aplicarse retroactivamente, ya que ello vulneraría derechos adquiridos y principios fundamentales del derecho laboral. La metodología combina análisis doctrinal, jurisprudencial y normativo, evaluando principios como la irretroactividad, progresividad y seguridad jurídica. This paper addresses the temporal application of Articles 99 and 100 of Law 27.742, questioning how they should be legally interpreted to guarantee legal certainty and the progressive realization of labor rights. The hypothesis posits that these provisions should not be applied retroactively, as this would violate acquired rights and fundamental principles of labor law. The methodology combines doctrinal, jurisprudential, and normative analysis, evaluating principles such as non-retroactivity, progressivity, and legal certainty. The structure includes: the general context of Law 27.742; a specific analysis of Articles 99 and 100; a debate on retroactivity; and critiques of regulatory gaps.
