Similarly, the strict prohibition of de facto guard that introduces article 611 of the Civil and Commercial Code inhibit the possibility of adoption, preventing the consideration of situations in which an affective bond was created between the child and his/her carer, which would contradict the principle of the best interests of the child that must be imposed in all decisions. La norma del Art. 607 in fine al regular la figura del referente afectivo solo permite otorgar un marco legal a la relación personal entre el niño y su referente a través de dos instituciones: la guarda y la tutela; dejando fuera a la adopción. Del mismo modo, la rigurosa prohibición de la guarda de hecho del Art. 611 del Código Civil y Comercial veda la posibilidad de la adopción, impidiendo considerar aquellas situaciones en las que se generó un vínculo afectivo entre el niño/ay su cuidador/a, lo cual contraría el principio del interés superior del niño que debe imponerse en todas las decisiones que se adopten.
