La persona endeudada es aquella persona humana que no puede hacer efectivo su derecho a liberarse de una o varias deudas, que no solo pesan sobre su patrimonio, sino que también ponen en riesgo otros bienes que integran su personalidad. En este trabajo haremos un análisis de algunas decisiones judiciales post Código Civil y Comercial (2015–2020) que han aplicado distintas herramientas del derecho privado para tutelar a las personas endeudadas.
