description In the present work, we ask ourselves about the usefulness of public policy, its measurability and the adequate tools for continuous control of its design and implementation. Based on the Open Government Partnership experience, which was launched by President Obama during his first term of government – and cautioning that the simple use of the website by Public Administrations does not imply compliance with “open government” standards – public policy is defined as the one which tends to solve “relevant public issues”. To this end, the public policy making process consists of the following stages: agenda setting, formulation, adoption, implementation, follow-up and evaluation. Likewise, the attempt is to classify such stages and establish a value system on which public policies need to be legitimized. Finally, it is considered that the issue of public policy should be included in law studies, taking into account the knowledge that public information is a form of infrastructure, at the same level of importance as other infrastructures (water, electricity, roads). If so, the universities could form, jointly with several government levels, a matrix for the generation of public value data, to allow building governmental action systems and processes with social participation and control with the purpose of observing the performance of governmental organs and their officials and to observe how they manage decision-making as well as materials and human resources, to ultimately tend to reduce corruption levels and improve the use of State assets, and also to empower citizens for them to make better decisions, not only at the time of issuing their vote.

En el presente trabajo nos interpelamos sobre la utilidad de la política pública, su mensurabilidad y las herramientas adecuadas para el control permanente de su diseño e implementación. Partiendo de la experiencia del Open Goverment Partnership a instancias del presidente Obama durante su primer gobierno -advirtiendo que la simple utilización de la web por parte de las Administraciones Públicas no implican cumplir con estándares de ‘gobierno abierto’-, se define a la política pública como aquella tendiente a resolver ‘problemas públicos relevantes’. A ese fin, discurren en un proceso consistente en: agenda, formulación, adopción, implementación, seguimiento y evaluación. Asimismo se intenta una clasificación de las mismas y una puesta a punto de un sistema de valores en los que necesariamente deben legitimarse. Por último, se considera que la problemática debe estar contenida en los planes de estudio de las carreras de abogacía, bajo el entendimiento de que la información pública es una forma de infraestructura, con el mismo nivel de importancia que otras infraestructuras (agua, electricidad, caminos viales). Las universidades, entonces, pueden constituirse de manera articulada junto a diversos niveles estatales, en la matriz que genere datos de valor público, permitiendo forjar sistemas y procesos de actuación estatal con participación y control social, a fin de observar el desempeño de los órganos gubernamentales, sus funcionarios, ver cómo toman las decisiones, qué hacen con los recursos humanos y materiales, para en definitiva, propender a la reducción de los niveles de corrupción y a la mejora en la utilización de los bienes del Estado, al empoderamiento de los ciudadanos para que ellos también tomen las mejores decisiones, no sólo al momento de emitir su voto.
