It is essential to identify people who are in unequal position in the city and to consider the attribute of care as a matter of justice in order to assure mobility. Mobility is a human capacity without which people can not have a decent life. The concept of sustainable mobility, increasingly present in the territorial policies and strategies of the European Union, assumes that citizens living in cities, towns or villages, disposal conditions and accessibility and mobility choices that give them safe, comfortable travel with acceptable times and affordable. It also implies that their mobility is exercised with energy efficiency and reduced environmental impacts. But above all what is imperative is to win the civil society to a new culture of mobility. This challenge will require a profound change in behavior to the individual citizen level, citizens groups, companies, institutions and the collective membership of proposals and policies in favor of sustainable mobility. The methodology used in the study was the grounded theory, which enabled the systematic analysis of transport policies. We carried out the survey of federal laws in force in the Brazilian capitals that recognize the relationship of dependency and care for the acquisition or maintenance of urban mobility. The main result of the research showed that the introduction of the focus of basic human capacities favors the construction of fairer transport policies, as it increases the chances of set of people to participate in social relations informed on principles of equality, justice and dignity.

Este trabalho tem como tema o fenômeno da mobilidade urbana e sua importância para a inclusão social na sociedade contemporânea. É fundamental reconhecer pessoas em posição desigual na cidade e considerar o atributo do cidadão como questão de justiça para a garantia de mobilidade. A mobilidade é uma capacidade humana sem a qual as pessoas não podem ter uma vida digna. O conceito de mobilidade sustentável, cada vez mais presente nas políticas e estratégias territoriais da União Europeia, pressupõe que os cidadãos, vivendo em cidades, vilas ou aldeias, disponham de condições e escolhas de acessibilidade e mobilidade que lhes proporcionem deslocações seguras, confortáveis, com tempos aceitáveis e custos acessíveis. Implica, ainda, que a sua mobilidade se exerça com eficiência energética e reduzidos impactos ambientais. Mas acima de tudo o que é imperativo é conquistar a sociedade civil para uma nova cultura de mobilidade. Este desafio pressupõe uma profunda alteração comportamental a nível do cidadão individual, de grupos de cidadãos, de empresas, instituições e a adesão coletiva a propostas e políticas em favor de uma mobilidade sustentável. A metodologia utilizada na pesquisa foi a teoria fundamentada, que possibilitou a análise sistemática das políticas de transporte. Realizou-se o levantamento das legislações federais em vigor nas capitais brasileiras que reconhecem as relações de dependência e cuidado para a aquisição ou manutenção da mobilidade urbana. Os principais resultados da pesquisa mostraram que a introdução do enfoque das capacidades humanas básicas favorece a construção de políticas de transporte mais justas, pois amplia o conjunto de possibilidades de as pessoas participarem das relações sociais embasadas em princípios de igualdade, justiça e dignidade.
