Healthy environment consists of a third,generation human right which is closely linked to the fulfilment of other human rights, such as the access to potable water. There is limited environmental criminal laws enacted in Argentina. Therefore, this impacts directly in the effective protection of the drinkable water. The general objective of the paper is to analyse national regulations related to the preservation of drinking water in the country previously mentioned. In addition, this is related to a selection of jurisprudential cases to evaluate whether its application is efficacious when in practice. The design of this study will be documental research. The fieldwork will be carried out at the Environmental Consultant which depends on the “Instituto de Ecología y Desarrollo Sustentable”, of the “Universidad Nacional de Luján”. In this place, consultations will be followed up by the population. To sum up, three specific cases linked to the drinking water will be analysed in this paper. El agua potable es un bien esencial para la vida, de igual modo garantizar un ambiente sano y la protección a las fuentes de agua potable es indispensable para asegurar la calidad de vida y el desarrollo de las generaciones presentes y futuras. El ambiente sano constituye un derecho humano de tercera generación que está estrechamente vinculado al cumplimiento de otros derechos humanos, como el acceso al agua potable. En Argentina se ha dictado escasa normativa penal ambiental y esto impacta directamente en la efectiva protección del agua potable. El objetivo general del trabajo es analizar la normativa nacional perteneciente al ámbito del derecho penal en Argentina, vinculada con la protección del agua potable y una selección de casos jurisprudenciales, con la finalidad de identificar la situación de base, su desarrollo y evaluar si su aplicación es efectiva en la práctica. El diseño del trabajo será de tipo bibliográfico,documental, de campo y descriptivo. El trabajo de campo se realizará en el Consultorio Ambiental dependiente del Instituto de Ecología y Desarrollo Sustentable, de la Universidad Nacional de Luján, donde se dará seguimiento de las consultas realizadas por la población en general y se analizarán tres casos en particular vinculados al agua potable.
