El art. 2448 busca como objetivo la igualdad de condiciones, de oportunidades, leyes equitativas, no discriminatorias, y sostener el principio de solidaridad familiar. No obstante, al permitir que el causante, opte por mejorar al ascendiente o descendiente discapacitado y al mismo tiempo, pueda realizar liberalidades sobre su porción disponible, incluso a favor de un tercero; ataca ese principio; pues disminuye aún más, la legitima global del resto de los herederos. Por supuesto, que el ordenamiento jurídico, tiene como rumbo, la evolución de una red social que contenga jurídicamente, y a la vez tutele a ciertos sujetos, por ejemplo, los discapacitados, pero al mismo tiempo debe proteger al resto de los legitimarios que también merecen ser resguardados o tutelados-, y son colaboradores del proyecto de vida familiar; no debiendo ser “castigados” o destinados a recibir menos, por el sólo hecho de tener un hermano con facultades disminuidas.
