En Argentina no contamos con una Ley especial que reglamente de forma clara, uniforme y completa el ejercicio de las acciones colectivas, y más específicamente, que regule las acciones dirigidas a proteger derechos individuales homogéneos. Es necesario instaurar un régimen legal uniforme y claro para los supuestos en que un mismo hecho afecte intereses individuales homogéneos. Nos interesa con este humilde trabajo, acercar al lector al conocimiento de las acciones de clase y resaltar la operatividad frente a situaciones que requieren su abordaje desde un proceso que permita la unificación de demandas en un solo proceso, conformándose una clase demandante, y posibilitando de este modo, el acceso a la justicia. Sostenemos que “Legislar las acciones de clase en la Argentina derivaría en una mejora del servicio judicial como así también del derecho de defensa, cumpliendo con el mandato constitucional de afianzar la justicia”. In Argentina we do not have a special Law that clearly, uniformly and completely regulates the exercise of collective actions, and more specifically, that regulates actions aimed at protecting homogeneous individual rights. It is necessary to establish a uniform and clear legal regime for cases in which the same fact affects homogeneous individual interests. We are interested in this humble work, to bring the reader closer to the knowledge of class actions and highlight the operability in situations that require their approach from a process that allows the unification of demands in a single process, forming a claimant class, and making it possible to thus, access to justice.
