La responsabilidad civil deportiva constituye un supuesto de responsabilidad especial y, por ello, aun cuando muestra particularidades –de reglas y de normas aplicables- ellas no resuelven la totalidad de los problemas involucrados lo cual exige referenciarla al sistema general de responsabilidad civil. La responsabilidad civil del deportista debe ser juzgada según la regla general que determina su no responsabilidad por los daños causados, salvo que se constate un actuar intencional o una grosera vulneración de las reglas de juego. A su vez, las entidades deportivas responden por los daños causados a otros deportistas o terceros por sus jugadores profesionales en razón de la responsabilidad que incumbe al principal por los hechos de sus dependientes. En los daños sufridos o causados por los deportistas amateur, la responsabilidad de la entidad a que pertenece requiere la presencia de específicas notas que permiten ubicar esa relación en una situación intermedia entre el profesionalismo y el amateurismo, en sus formas puras. El organizador de un espectáculo o de una actividad deportivos responde frente a los que participan en ellos por deficiencia en las instalaciones y negligencias organizativas y tratándose de terceros –principalmente, los espectadores- la responsabilidad del organizador es de índole objetiva y de resultado. El art. 51 de la Ley 24.192 consagra un régimen especial de responsabilidad civil, en función de un factor de atribución claramente objetivo, derivado de una actividad riesgosa y sobre la base de una obligación de seguridad a cargo de la entidades participantes en un espectáculo deportivo. Sport civil liability is an assumption of special liability. Therefore, dispite it presents particularities – of rules and aplicable standards – it fails to settle the complete range of problems potentially involved, which is why it is to be indexed to the general system of civil liability. Civil liability of profesional athletes must be tried by the general rule which determines their lack of responsability except that an intentional action or a outrageous infringement of the rules of the game are confirmed. Moreover, sport organizations take responsibility for the damage caused to other athletes or third parties by their profesional players due to the responsibility concerningo the head for the deeds of their dependents. In the damages suffered or caused by the amateur athletes, the liability of the organization to which he or she belongs requires the existence of specific notes in order to place this relationship in an intermediate position between profesionalism and amateurism, in their pure forms. The organizer of a sport show or activity is held liable for the ones who take part in them, for premises deficiencies and organizational negligence, and, in the case of third parties – mainly the audience – the organizer‘s liability is objective and applies to the result.
